On June 3, 2022, the U.S. Army Corps of Engineers (Corps), published a Federal Register notice regarding its efforts to modernize the Civil Works program through a number of policy related issues. The notice discusses the consideration of potential rulemaking actions regarding its use of Appendix C to meet its responsibilities under Section 106 of the National Historic Preservation Act for its Regulatory Program. It also discusses updates to the Corps’ Tribal Consultation Policy and guidance on the Corps Tribal Partnership Program. This FR notice provides an opportunity for Section 106 stakeholders to share their experiences with Appendix C, and the challenges they encounter in protecting historic properties when using it.

The Corps intends to hold a series of public and tribal virtual meetings, as well as a written docket, to gather oral and written comments that will be used to inform future decision making related to these topics. We encourage all preservation partners to provide written comments or participate in these upcoming meetings.
