Historic Preservation and the Recovery Act

The American Recovery and Reinvestment Act of 2009 (ARRA) requires that federal agencies
implement a broad array of federal projects and programs in a short period of time to support job
creation and stimulate the economy. Many of the programs funded through ARRA, both existing and
new, have the potential to support the preservation and productive use of historic properties. Federal
agencies are responsible for ensuring that historic preservation values are integrated into their
decision-making and that impacts to historic properties are fully addressed through the Section 106
process. The ACHP has encouraged federal agencies to tailor Section 106 reviews to facilitate creative
approaches that can be implemented within ARRA deadlines. In order to achieve preservation outcomes
that are in the public interest, the Section 106 regulations provide for the involvement of stakeholders—
including local, state, and tribal governments; developers; preservation advocates; and private citizens
—in historic preservation reviews for federal projects. Federal agencies that embrace the principles of
consultation with diverse stakeholders are more likely to achieve the goals of ARRA while considering
opportunities to protect historic properties and integrate cultural resource management into project planning.
